Criminal Case for Filipino Credit Card Defaulters? Really?

Are you afraid that the credit card debt agencies will file a criminal case against you? better read this.

I am grateful to receive a lot of comments and likes on the article I wrote last year about credit card defaulters like me facing the same issue with credit card debt collectors in the Philippines. Since then, I am receiving questions from them and left unanswered because of busy schedule. I apologize. But now is the time that I have more time to answer all your enquiries. Yes, today I will start writing more about your credit card debt problems and how you can resolve it. 

For today, let us discussed the problem of my reader named Travis

“i have a question cause i have a credit card debt.. somebody told me that you should never run or hide with these people because if you do its a criminal case for them because your intentionally not paying your debt.. im just renting a apartment, and im always changing places, my previous place in manila is they’re always hunting me (the debt collector) my previous room mates said that everyday they keep on calling, im so afraid when one day thay said that 2 police came on that place.. pls help me on this, and also one time i talk to the debt collector and they offer me a monthly plan and it is way too high for me, thats the reason why i move to another place..”

My answer:

Travis and I experienced the same thing, being paranoid about resolving our credit card paranoia, but thanks to a blogger named banker, now I know the truth behind this and I will tell you. No! You will not be imprisoned by defaulting your credit card. Here in the Philippines, as per our bill of rights article 3 section 20:

No person shall be imprisoned for debt or non-payment of a poll tax.

Regarding the police that chased Travis, it is intentionally done by credit card debt agencies to scare people like us. Don’t believe them. You may want to call the NBI to report about this and can file an extortion case against their police officials who clearly appeared as an accomplice by your credit card debt collectors.

Since non payment of credit cards is not a criminal case but only a civil case, you can get an NBI clearance. Our NBI only handles criminal case and not civil cases like defaulting credit cards.

Criminal case against credit card non-payers? Is a big no! Again you will not be imprisoned. Be placid.

    i have an outstanding debt in dubai, i left dubai since 2008. and now so many phone calls from the collectors, telling me that they will file a case against me. and they also said that they will contact our Barangay hall to find me in our place and put me on jail. is it possible for the barangay to handle my case in Dubai? or even our Law here, is it possible that they will issue a travel ban for me? and pick me up to put me in jail?

Yeah, parang sinabi na rin nyang mamatay ako di ba? dahil sa utang kong less than 20K! Nabasa ko din na pwedeng magreklamo sa Bangko Sentral ng Pilipinas dahil paglabag na rin to sa BSP 454 something nila (”the use of obscenities, insults, or profane language which amount to a criminal act or offense under applicable laws;”), magagamit ko ba ‘to as evidence kung magrereklamo ko sa BSP? Makikinig kaya sila?Gusto ko lang din kasing turuan ng lesson yung collector kasi parang sobra na yata yung ginagawa nya. pumunta na rin sya sa office namin dati at kung anu-anong pinagsasabi sa receptionist. nakakahiya na talaga…ano bang pwede kong gawin?

  5. tulad ng dilema ng mga credit card defaulters, maraming tumatawag dito sa ofice at sa cellphone, 2 months pa lang na delingquent ako sa pagbabayad dahil sa dumating ang mga hindi inaasahan bagay. mayroon akong 8 credit cards na ever since ay binabayaran ko ng walang palya, pagpasok ng taong ito doon nagsimula ang kalbaryo ng buhay ko. 5 sa mga cards na yan ay umabot na sa P100k++ including jan ang sobrang taas na interest at mga late payment charges, may mga nagsasabi na malaki ang chance na makulong lalo na kapag ang limang cards na yan ay hinawakan ng iisang collection agency. ano ba ang pedeng mangyari or maari kong gawin? may nagsabi na may bagong batas ngayon tungkol sa hindi pagbabayad ng cards na maari kang makulong. gusto ko lang pong malaman ang totoo at tungkol sa bagong batas na ito, please help, thanks!

  6. hi clickmarbin,,thank sa mga shinare mo…yung case ko naman personal loan sa ps bank,,tapos pinag issue ako ng pdc..tapos nag close na yung checking account ko so lahat ng checks ko with 1300 lang naman every month tumalbog..tapos nagtext and kapitan namin sa kakilala ko at sabihin raw saken na tumawag ako kay fiscal de luna raw..do you think makukulong ako..nung tinawagan ko yung agency na may hawak ng case ko magbabayad raw ako ng 40k omg san ako kukuha nun…me kaso ba sa bouncing checks ko since nag close na yung checking account ko kya talbog lahat ng checks ko…please help

  8. HELP!!! URGENT!!!
    First of all, salamat sa mga ganitong forums at medyo nakaka-kalma ng konti.

    My card company emailed me that they will grant me a payment scheme na may discount to payoff my delinquent account. When I replied by email, ayaw nilang e-disclose ang outstanding amount kasi confi daw kelangan over the phone,not by email. On my part, ayokong ibigay ang phone number ko kasi 1. I will pay fees kahit incoming calls 2. Ayokong tumawag sa kanila kasi mag-reregister ang number ko and they might end up calling me all the time at mahal din ang outgoing call. So, after several emails ko to them to prove my identity para maibigay nila ang info na kelangan ko to pay, walang reply ang bank, instead my auntie called me na hinaharass na daw sila ng law firm.

    Sabi hindi daw ako makakauwi ng Pilipinas kasi rereport daw nila ako sa immigration. Pauwi pa naman ako kasi birthday ng anak ko, matagal ko nang hindi nakikita.

    Help, any advice on this? Totoo bang pwede akong maharang sa airport?

    another thing, can i negotiate sa bank para mabigyan ako ng discount to pay off my debt? kahit installment? papayag kaya sila? Like upto how many % kaya from the principal or total outstanding?

  10. Hi! I would like to know if It is really required that I update the card company of my current employer? Like most of you. I have a credit card debt which I tried to settle with the bank but even before I know it, inendorse nako sa collection agency. When I left my previous employer, nagupdate ako ng billing address including my updated cellphone number and when I emailed them of my willingness to settle through their amnesty program, sabi I should get in touch with the collection agency na lang daw, which at that time I was not yet employed with the company that I am currently working for. Now there’s this so called law office saying na criminal case daw yun because I did not update the bank of my current employer. It confuses me kasi the bank told me to coordinate with the collectionagency instead. I know that they are using their usual harassment tactics. I just want to know if there is really any criminal liability on my part and how should I approach this law office (Prime Alliance). I think court settlement is better, right? How should I tell them? do I need to sign any documents with them if ever I choose a court settlement? Thanks so much!

    i have credit card debt with SCB and they keep on calling me through my mobilphone pero di ko sinasagot kasi in 2009 i already requested for an amnesty pero di nila na-grant because di pa raw entitled yung acct ko. last Feb 2011, nagkadefault ako and I already requested for another amnesty, denied ulit..dahil dun di ko na sinasagot mga calls nila ksi it pissed me off dahil i’m financial in distress tlga ngayon. Just today, i was caught by their collection dept agent, tintanong pa daw sa officemate ko yung HR number namin because i’m hiding from them to defraud them. they offered to discount my account daw ksi di na raw pwede yung amnesty. tanong ko lang, what documents will i ask from them? they are pressing me to pay my 1st payment by monday, para daw maayos nila yung acct ko. actually, di ko kayang bayaran yun..kaso nga i am an officer here in our office, at nanggugulo sila. What shall i do? pwede na ba kong magseek ng legal advice? nasa pre-legal na raw kasi acct ko.

    LAst dec.2010 lng po nacancelled creditcard q..kc less than minimun amount required ung binabayad q monthly kc nagka financial problem aq. Actually supplementary aq ng father q. Nagkaron lng ng account s bank father q b4 kya xa nagkaron ng crditcard. Responsibilty q to kc never nman tlaga ginamit ng father q card nya eh,d po xa marunong. He’s 68 yrs.old, broke and bankrupt. My 4 demand letters n rin po aqng nariciv fr.different collection agency. One time nag offer cla s kin ng installment, 2,800 monthly for 36mos. But i need 2 depoct 8000 first as a down payment daw. Di aq nkapagbigay kc nga d q kya ung gnon klaki since nwalan n q ng work and also im only renting an apartment. Willing nman tlaga aqng byaran but not in full. Since dec. after d cancellation of my card,di po aq pumapalya ng pagbabayad monthly un nga lang di po consistent minsan kc 1k minsan 500..un lng kc kaya q eh. Bale 6mos.n pong cancelled card q,pero monthly nman nagbabayad aq kung ano lng kya q. Worried p rin aq clickmarbin kc ung last letter nila meron nkaindicate don na R.A 8484, warrant of arrest, etc…. Nhihiya n po aq sa father q eh kc syempre ung letter eh under his name. Sobrang bait lng tlga ng father q,ni isang word wla aq narinig s knya about this..pero feeling q worried din xa. Ayoko n dhil d2 eh magkasakit xa kakaicip. Clickmarbin pls.enlighten me,,namayat n rin kc aq kakaicp eh. Feeling q di n normal buhay q.

  14. hi clickmarbin, my situation is a bit different. I have agreed that my officemate’s stepdaughter’s hospital bill will be charged to my credit card. It was an emergency coz they had a road accident. To ease his burden of repaying at once the full amount he owe me on my credit card, I applied for a balance transfer to my other credit card na wala pang laman, so it will be amortized monthly. I trusted him that he will fulfill his obligation. However, I was transferred to another branch and I found out he was not paying, worst, he resigned from work and I could no longer trace his whereabouts. I was left with his debt on my credit card, and it’s really hard on my part to be the one paying because obviously I didn’t benefited from that transaction. I once received an attorney’s letter from a law firm telling me that if I don’t settle or negotiate, a case of violating R. A. 8484 will be filed in court. Did I really violate RA 8484? No payment has been made since the approval of the balance transfer, by the way. And so far, I haven’t received any collection letters anymore since the first. But what should I do if they will pursue me? Please help. This happened 3 years ago, but I am still losing sleep every time I remember this.

  17. Hi. In behalf of everyone you have helped with your useful advice, I would to say thank you. I have experienced being hounded by collecting agent for a debt that I wasnt even obligated to pay. Psychologically it really is very distressing…anyway, I managed to solve most of it to make them go away.

    I came here for another reason though, Someone owes me a small amount of money. She told me the money was for her sick daughter. I sent her the moer one money straight away..She told me she will pay after one month..After one month she told me in another month..I got annoyed and told her to tell the truth about the payment..After that I never heard from her again…My other friends told me she always make the same excuse “sick daughter” and then never pay back..Do you have any ideas how I can get my money back…Honestly, I have been the most patient with her..I never told people what she has done…

  19. Hi! My mom gets scared by this people. Her debt is relatively small but they want her to pay in two installments which she cant afford. Sabi sa sulat, iffile daw sa supreme court!

Hello! just got a call from another Law Office. after 2 yrs of not hearing anything from them, eto at tumawag na ulit…Mejo firm sya makipag-usap and told me that i am scheduled for a personal visit from their lawyers tomorrow here in our Office. So sabi ko, open naman ako kung pupuntahan nila ako. I am not hiding or running away from my obligation, i’m just really not capable of paying it. She told me that from 45K, it blew up to 186,000. And now, if i can now the credit card company will give me a discount of 43,000. (payable in 2 payments). If i can do 1 time payment, they can give me 35000. If i can’t pay, they will haunt me. i told her i can’t really pay them right away and if there’s a monthly installment plan so i can pay them. wala daw. i ask her that she can do a credit investigation about me so they can know my financial status.

    My question is, can i call the credit card company directly and ask them if they have a monthly installment payment scheme?

  23. Can someone please help me out about the correct person to talk to about the Fraud charges. HSBC told me that they couldn’t file any more dispute na P46,000 kasi over 30 days na daw. Back in May 2011, I initially report these two disputes and they told me that the second one was a “floater” and I should not worry about it. So now, they demanding me to pay this as it eventually got through. The late charges and interests are keep filing up!! I refuse to pay this! Should I be worried about this abuse when HSBC Collection Department has misinformed me and messed it up in the first place? Can someone please give advise? I work and live abroad and I really don’t want to enter into this type of chaos since I have been a good payer and I never missed pays with HSBC Credit Card. Now I feel like I am being harass by them thus I have been stressed out lately.

  25. Hi! I was a victim of a credit card fraud, my credit card was used to purchase airline tickets on line. The following day the credit card issuer called me up to inform me of the unusual transaction which I confirmed that I did not make. Two airline tickets were purchased using my card, one was booked for a flight 3 days after the transaction while the other was booked for a flight 7 days after the transaction. Since I reported the fraudulent transaction the following day it was purchased on-line, can’t the credit card issuer have the tickets cancelled by the airline companies since it was reported days prior to the flight?

  26. Hi everyone, I want to share relative issues re credit card debts.
    I was in Dubai 2 years ago stayed there for 5 years, finally 2009 due to visa problem I was in jail for 30 days and deported, before my release even if my family is negotiating my stay there to face my liabilities, nasampahan ako ng case from Dubai First Bank my family was asked to pay some amount, then I got the release papers and have my travel documents done by the embassy for my travel back here in our home country.
    Now, as I am starting again working, Collections agency (Bilkish and ENZI )is harassing my family for the other banks who is after my payment for debts I left in Dubai. Lahat nang klase nang pananakot gagawen nila, pupunta sa bahay will check assets at pupuwersahing magbayad, I am experiencing the same, nakulong na ako at lahat doon since the Department of Naturalization and Resindences asked me to leave their country I thought all the debts and liabilities will be waived of understanding also that the bank will have to consider the default payment as their lost profit. I am ready to face them during the negotiations when I was there?
    Ang hindi ko maintindihan Filipino are taking the advantage of this situation para kumita at pagkakaitaan. And besides hindi ko gustong takbuhan ang pagkakautang ko? Kagaya ng marami I want to pay as much as possible kung kakayanin ko mga demands nila sa pagkakaalam ko wala na akong pagkakautang since thier government decided to bring me back home at any expense.
    Maraming takot kumuha nang NBI clearance I got one last Dec 8 for travel abroad. Hindi Crime ang hindi pagbayad ng utang and I believe wala rin itong travel ban or even a hold departure.
    Ang worry ko na lang hindi ako sigurado kung alin sa mga naghahabol saken ang na issuehan ko ng cheque that can be bounced maaari kong harapin ang kasong ESTAFA but not here in the Philippines??? Tama po ba? since Bank Turned it over to a collections agency?
    Kahapon lang kasi our neighbors reported there were some men came to our house making a scene may kaso daw ako? warrant of arrest OA ha?
    Ingat din sa mga kapitbahay once kasi anybody from your area confirmed that you are visible there hindi ka nila tatantanan.
    Magpapasko naalala ko spending it in jail sa Dubai year 2009.

  27. Hello.. everyone! Same here I have a problem with my HSBC credit card! I planned to settle my account including installments since last JULY I coordinated with their CSR and gave me the amount of my running balance (P69k ) including the remaining installments. I paid this tru HSBC personal loan transfer and gave me different amoutn much higher that what I was told (74k ). They said this is the current balance thier system generated. So in my determination to clear my account I still pay for it! Then, right after payment was made, I called their hotline to inform them that I have paid all my transactions including the installments so I am expecting that on my next billing I will not see any installment and transactions unless I use the card again.

    On the next billing after the settlemnt I made, I received thier billing amounting to zero. Since, It is zero I didn\\\’t bother to check the entire billing.

    The next month billing, I was able to check the SOA. I found out, installments was still present in my billing. So I immediately called their hotline to verify what happened. CSR firmly told me that it will automatically display all the transactions I made since their system is new! But I will be free of charge! So since I am using thier card for such a long time and haven\\\’t got any issues so far I trust them much in terms of my billing. With this trust, I seldom check all the details in my SOA. SO after I was instructed by thier CSR that I am free of charge of my installments I started ignoring it in my SOA.

    Sad to say, after another billing I was surprised that when I check on my credit limit it seems there\\\’s something wrong. If they are not chrging me of the remaining installments it should reflect on my available credit limit! But it didn\\\’t reflect on my available limit! So I checked all the Bills from them since JULY, and found out that my instruction to them to setlle all the trsaction including installment was not followed instead I have an over payment which is supposed to be for installmments and not for swipe transactions!

    So I request in their hotline and collection department several times thru email and calls but it seems they do not take any action on my request because until now they are not giving me the correct computaions. What they did is they terminate my installment then added this to my running balance which is supposed to be cleared since JULY!!! I send them email that I will not pay any amount unless they give mne the correct computations!

    Thier collection department just called me and discuss to me verbally the computations they made. When I asked about a copy of my SOA or thier computaions they said it is not possible because they just do it manually and took time review my account. HOW COME THEY CANNOT GIVE ME A COPY??? Meaning they will not input their adjustment to my account in thier system? So funnny!!! They even billed me a finance charge since I didn\\\’t pay even minimum amount due since I am still waiting for thier reply on my request and they just responded to me 3 days after my due date. I just told their collecting agent that I will verify thier computation first before I make any payment. But still I will not pay them unless they give me the correct SOA!

    Any advise can you give me about this?

  29. hi ask ko lng i was deliquent for 6 months now from citibank,,this day,,a name dennis de guzman called me at the office and told me i dont comply with my commitment, i told them i never commited but i will try to pay, since i dont have that enough money..he then told me that they will be sending me letter and forwarding my name/case for legal cases, and i need a lawyer,, i will be block listed and etc…
    what will i do? can u help me on this?

  33. if you can’t pay, don’t pay. they cant even get your things in payment of your debt. bawal po sa batas yun. bawal din ang harassment sa phone, bawal din ang extorsion, bawal din ang trespassing kahit pulis pa yan kung walang order ng korte.

    from 2006-2008, 5 credit cards meron ako at 2 loans… first year wala akong palya, pero lumulobo ang interests at balance. hindi ko na kinaya bayaran. na survive ko ang mga harassment nila dahil i ignore them. mas maganda mag focus ako magtrabaho para kumita, instead of wasting my time talking to them who are unreasonable and senseless. almost 600k ang utang ko dahil lang sa interests. pero kung susumahin lahat, ang utang ko lang talaga nasa 50k na lang, dahil sa mga patong walang nababawas sa principal ko. ang binabayad ko sa interests napupunta.

    NBI clearance is clear. only criminal case will be reflected sa NBI. kung settlement ng utang, sa barangay hall lang ginagawa diba? so bakit mapupunta sa NBI yan?

    kung litigation, masyadong magastos at matagal. will you think ang bank will spend 60k for acceptance alone, kung ang utang mo lang is 20k?

    may certain period para maging “loss” ang utang mo sa mga banks. after nun, wala na sila pake-alam. kaya ginagawa nila, binebenta nila sa mga collecting agencies.

    i suggest paki search yung forum that talks about our issues. meron nga doon abogado, konsintidor sa mga katulad natin. actually, he’s just making our burdens light.

    wala pa po nakukulong nang dahil sa utang. in the history po, wala pa. ang estafa ibang scenario po yun. hindi sya applicable sa case natin sa mga credit cards.

  34. mystery, sa opinion ko kung grounds nila ay estafa, hindi pwede yun kasi ang PDC as a requirement has a forced grounds na napilitan kang mag issue dahil requirement for you loans yan. pero need natin verify kung ano ba talaga ang liabilities natin sa PDC.

  35. hi i am already a deliquent citibank credit card holder since oct 2011..prior to being deliquent i have purchased an online ticket last aug 2011..magkakaroon po ba ako ng problema upon checking in?my flight is this feb 14 and im kinda freaking out bka madeny ako at nakakhiya na andun na ako tska ako madedeny..may nangyayri bang gnung bagay?pakisgot naman po ang tanung ko..maramign maraming salamat po!

  38. hi everyone! Still may account in HSBC is very complicated. There was an error on their part way back July last year that results into to a complicated account. I paid the whole installment, but then the agents who handled my account did not terminate the installment.So it\\\’s still appearing on my billing.They treat it as an overpayment!

    Since then I tried calling and requesting for re-computation and ask for a correct billing before I pay them. Since then I started paying only the minimum amount due because I\\\’m still receiving incorrect billing from them. They do not accept their mistake and even did not correct the error on their part until now. They are claiming that their charges are correct since I am only paying minimum amount due. But how will I pay for the whole amount when they are giving me incorrect billing statement. From then they keep on putting charges in my account. The original amount is only around 60k but then now its almost 85k.

    After all the efforts sending them emails, calling them and talking to their agents and collections department still they do not honor my request to waive all the charges. I told them I am willing to pay only the balance I used excluding their charges but on a monthly basis.

    They said my request is already answered/closed and the resolution was final. They are giving the payment arrangement 1st option is to pay in a discounted amount of 63k but I have to pay that in full for a month only!First is 20k on the 2nd week of March then the remaining amount is on the end of March!

    2nd Option is 12mos Payment arrangement, wherein the overall balance is around 80k included some of the charges and still I need to initially pay them 20k in cash then before I can avail of their offer 12mos payment.

    3rd option is 6mos payment, wherein the overall balance is around 70k included some of the charges and still I need to initially pay them 20k in cash then before I can avail of their offer 6mos payment.

    I explained to them that the only option I have now is to pay them on a monthly basis only and I am willing to pay them the whole balance I incurred 60k.But then they do not agree!

    Since due to their late respond and action in my case the money I have allotted for them last year was used to other priority because unfortunately, my wife lost her job that time so I need to budget my earnings for the whole family needs.

    They told me that if I will not pay them for the said period of time they will put my account to their legal department. I still insist that I am still willing to pay them to the way I can base on what I can afford to pay them.

    I already told them that I will wait for the court to decide for me. Since from the start if only my account was handled correctly by their agents, my account will not become complicated like this.

    I also told them that what\\\’s important is the willingness and eagerness to pay..

    Any advise you can give me…

    Should I ignore them and still be firmed that this is their fault so I deserve to be given consideration.. besides I am a good payer and responsible card holder to them!

Before recession strikes in, I’ve been paying all of these obligations in an orderly manner until payments became late and eventually, with no choice, fully stopped . But before payments halted, I went to the banks to request for reinstructuring and consolidation with nothing good came out from them until I decided to just let circumstances take its toll. When I requested to have my credit card and loan consolidated, they declined saying that they don’t do such thing and instead offered me an arrangement to pay first the credit card on a year term and assured me that the loan interest will be on hold while I do the credit card repayments, and when done I could continue. I told him that even the normal installment alone is hard for me to raise, but since I was committed to clearing what I have owed in good faith, I would somehow find ways to comply with my obligation in good faith.     My story of delinquest cc was when I was younger, 2003 pa. I did not realized pa that time the effect it will have on me on not paying my credit card. My outstanding debt in Bankard is 20k. That time when I was delinquent the collection agency were sending letters and calling my parents house, I was not living with them na kasi by 2004. And yung company ko nagtransfer and nagclose na so hindi na nila ako makontak. Ang question ko is, if now I want to settle with Bankard, possible pa kaya na may record pa ako sa kanila? And hindi na ba ako forever maaapprove when I apply for a cc or any bank loans? It has been 7 years I think, and I applied for a BDO credit card recently but was declined.

The collector agency is always asking me to settle the amount of the 2 cards, I’m always telling them that I will pay them once I got my job. I already told them in Filipino (Tagalog na yan para maintindihan nila) BUT still they are forcing me to pay those 2 cards to them. Bottom line is, since hindi ko daw mababayaran, they will file case against me. I really don’t know if that is a criminal nor a civil. Hopefully it will just be a civil case.     Ano po pwede nyong advise?
    1. Nagrerent lng po ako and I\’m planning na lumipat ng boarding house. – pwede po ba akong lumipat ng bhouse?

    2. Wla npo ako sa previous job ko na nkalagay sa application for cc. Naghohombase nlng po ako ngayon

    3. Iba na din po number ko ngayon.

    4. Should I call the bank to update these info?

    5. Will they arrest me? What will happen kung lilipat po ako ng house?

  67. Hello po
    I have CC card then has a 68K card limit. I keep receiving demand letter stating about warning etc. Now i keep paying it until last July, pero yung amount na binabayad ko, hindi nagkasya sa minimum amount sa balance kasi I’m only paying when I have some extra since i lost my job. So obviously charges are keeping charging until balance have increase. So ngayun po yung mga taga hsbc pina forward na nila yung account ko daw sa collectors department which is the lawfirm. Now actually po yung balance ko ngayun is 90K then until it got to 112K. Hindi ko rin na alam kun mag kano nah bah yung exact balance ko na andun pa hsbc which also i failed to recorded it, I think the last time i have check if i remember is 28K, then it goes along charges until it reach up since i failed to pay exact minimum balance.
    Ngayun po pwde bah yung balance ko na siningil nila is mamaya kuna bayaran kong mayron na akong money. And what are possible actions na gagawin nila habang sinisingil ako. Salamat po. :(

    Need help!

    I went to HSBC ortgas branch,, Mag OTC sana ako sa payroll ko but the card was captured… so pmasok ako sa loob then nakita nila na may utang pa ako sa Credit card so sabe ttawagan ko daw muna ung Collection Dept. tas i-hohold muna daw nila ang sahod ko.. then sbe ko bawal yan wla naman ako pinirmahan sa CC na i-auto debit sa atm or saving acct kasi magkaibang acct un sbe nakalink daw… So pnasa ako sa Cust servce .. sbe possible daw na kukunin nila ung pera ko sa atm kng di daw ako mkipag aareglo sa Collection Dept.

    What to do???

    Should I call the collection Dept. since wala na tlg ako balak bayaran ang utang ko dun.. pero eto lng kasi na hsbc din atm nmen sa payroll.,..

    RA 8484 is against card defrauders. That means you are deliberately fleeing away from your obligations. In your case, you seem to be fleeing away since you changed your number and the bank can\’t contact you anymore.

    Once these banks cannot contact you anymore, they will have no other means to collect from you. Hence, they would think that you\’re fleeing away and would not want to pay your dues anymore. That\’s estafa.

    Now, if you changed any of your contact numbers or home/billing address you will need to inform the banks so they will still know where and how to get in touch with you. This will give them an impression that you are not hiding from them.

Hi i need help….i lost my job nd i have two kids husband k lng may work we cannot afford to pay for my hsbc debt which is amounting to 43k theyve been sending me letter bout the new law which is small claims, dis has been bugging me day nd night will i go to jail because of 43k debt?
